Terms of Use
Version 2026-01-04.1 · Effective date: October 20, 2026
1. Who we are and who can use this platform
Survived (“Survived,” “we,” “us”) is operated by [LEGAL REVIEW: insert company legal name], a company registered at [LEGAL REVIEW: insert registered address] (“Company”). These Terms of Use (“Terms”) govern your access to and use of the Survived platform (the “Service”), which is offered globally. The Service is intended for individuals who are at least 18 years old and legally able to enter into these Terms, and for prospective hiring companies accessing candidate information in accordance with the Privacy Policy and the relevant candidate’s consent. If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with its own data protection or consumer-protection law, the rights described in those laws apply to you alongside these Terms and are not reduced by them.
2. Beta service
Survived is currently offered as a beta, early-access product. During the beta, the Service is free of charge for both developers and companies; we do not currently charge either side for any part of the Service. Features, questions, matching behavior, and these Terms may change as we develop the Service, and we do not guarantee that any particular feature will remain free, available, or unchanged once the beta period ends. We will give reasonable notice before introducing any fees.
3. Your responsibilities
You agree to provide accurate, current, and complete information when registering and completing an assessment, and to keep your contact details up to date. You are responsible for maintaining the confidentiality of any invitation link or session associated with your account, and for all activity that occurs through it.
4. Invitation links and assessment rules
Assessment invitations are single-use, tied to your profile, and expire 72 hours after issuance if unused. Once you begin an assessment, your session remains valid independently of that invitation window. The assessment must be completed in one sitting; submitted questions cannot be revisited, edited, or resubmitted. You acknowledge this before starting.
5. Ownership of your submitted content
You retain ownership of the profile information, multiple-choice selections, and voice recordings you submit (“Submitted Content”). You represent that you have the right to submit this content and that it does not infringe any third party’s rights.
6. License you grant us
You grant Survived a limited, non-exclusive, worldwide, royalty-free license to store, host, process, review, and otherwise use your Submitted Content solely to (a) operate and improve the Service, including processing it with our AI models to understand and match your experience, (b) provide talent discovery and candidate review functions, (c) produce properly anonymized or aggregated analytics and commercial industry insights as described in Section 8, and (d) deliver other commercial services that are expressly disclosed to you at the time they are offered. This license does not transfer ownership of your Submitted Content to us, and does not grant us the right to sell or disclose your identifiable personal data or recordings to third parties outside what this Section and the Privacy Policy describe.
7. Employer access
When we identify a potential fit between your profile and a prospective hiring company’s needs, and in accordance with the consent you give at registration (or later withdraw), we may share a summary of your profile and relevant background with that company and facilitate an introduction or interview on your behalf. We do not share your voice recordings or full assessment responses with companies. That content is processed internally with our AI models to match you with companies’ needs, as described in the Privacy Policy. Employers accessing information through the Service are subject to their own agreements with us governing permitted use of candidate data.
8. Anonymized and aggregated data; industry insights
Where legally permitted, we may strip Submitted Content of your name and other directly identifying details, aggregate it with other developers’ data, and use or sell the resulting anonymized or aggregated information, including to companies as industry insights products, for analytics, research, product improvement, and commercial purposes. We only do this where re-identification of any individual is not reasonably likely. You agree not to attempt to re-identify any individual from anonymized or aggregated data we publish or share. This permission is separate from, and does not expand, our commitment in Section 7 not to share your voice recordings, full responses, or identity with employers without your consent.
9. No guarantee of employment or matching
Completing an assessment does not guarantee an interview, employment, or that any company will review or respond to your profile. Survived does not score, rank, or make hiring decisions on behalf of any employer.
10. Service availability and liability
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, except where such warranties cannot be excluded under applicable law. We take reasonable security measures but cannot guarantee uninterrupted, timely, secure, or error-free operation, particularly during this beta period. To the maximum extent permitted by law, the Company and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising from your use of or inability to use the Service. Because the Service is currently provided free of charge to both developers and companies, and to the maximum extent permitted by law, the Company’s total aggregate liability arising out of or relating to the Service or these Terms will not exceed one hundred United States dollars (US$100), or, if greater, the total amount you paid to the Company in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited or excluded under applicable mandatory law, including liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence, or any statutory rights available to consumers in your jurisdiction.
11. Indemnification
You agree to indemnify and hold harmless the Company and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third party’s rights, except to the extent caused by the Company’s own breach of these Terms or applicable law.
12. Suspension, termination, and deletion
We may suspend or terminate your access to the Service for violation of these Terms, suspected fraud or abuse, or at your request. You may request deletion of your account and associated data at any time, subject to the retention exceptions described in the Privacy Policy.
13. Intellectual property
The Survived name, platform, question content, and underlying software are the property of the Company and its licensors and may not be copied, reproduced, or used without permission, except as necessary to use the Service as intended.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated before they take effect where required by law. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing law and dispute resolution
These Terms are governed by the laws of [LEGAL REVIEW: insert governing law/jurisdiction], without regard to conflict-of-laws principles, except where applicable mandatory law in your country of residence requires otherwise (including mandatory consumer-protection or data-protection law that cannot be contracted around). Any dispute arising out of or relating to these Terms that cannot be resolved informally will be subject to [LEGAL REVIEW: insert chosen dispute-resolution forum]. This section does not deprive you of any right you have to bring a claim in your home jurisdiction’s courts where applicable law guarantees that right.
16. Contact
Questions about these Terms can be sent to [LEGAL REVIEW: insert legal contact email/address].
This page reflects our good-faith drafting intent for a beta-stage product, including alignment with GDPR and UAE PDPL principles, but has not yet been finalized for a specific operating entity or legally approved for the jurisdictions in which the Service operates. It should not be relied upon as final until reviewed by qualified counsel.
